1. The program
A Race Against Blindness ("RAB," "we") offers a recurring text-message program (the "Program") that sends news about our fundraisers and the research they fund, updates about fundraisers you have entered, donation receipts and entry confirmations, winner announcements, event reminders, and occasional requests for support. Messages are sent from 855-439-0122 by our messaging provider, Klaviyo. RAB is an Arizona nonprofit corporation exempt under Section 501(c)(3) of the Internal Revenue Code, EIN 92-2174042, located at 3317 S Higley Rd Ste 114-110, Gilbert, AZ 85297.
Some messages promote fundraisers in which donors receive sweepstakes entries. Every such fundraiser has a free method of entry and is governed by Official Rules linked from the message or from araceagainstblindness.org/fundraisers. No donation or purchase is necessary to enter or win, and you will never receive entries for joining or staying in the Program.
2. Your consent
You join the Program by checking an unchecked box on one of our forms, by texting a keyword we publish to our number, or by replying to an invitation we send to a number you gave us. The consent you give reads:
By checking this box [or texting JOIN], you agree to receive recurring automated marketing and informational text messages from A Race Against Blindness at the mobile number you provided. Consent is not a condition of donating or of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. See our SMS Terms and Privacy Policy.
You confirm that you are at least 18 years old, that you are the account holder or authorized user of the number you provide, and that you will tell us if you give up the number. Your consent is to RAB alone; we do not sell, rent or share your mobile number or opt-in information with anyone for their marketing.
3. Frequency, cost and timing
Message frequency varies with our fundraiser calendar; we will not send more than 8 marketing texts per month or more than 3 in any 24-hour period. Message and data rates may apply; check your plan. We send marketing texts only between 8:00 a.m. and 8:00 p.m. in your local time zone, as determined by your area code or the time zone in your profile, and we observe stricter state rules where they apply. Messages you have specifically requested (such as a reply to a question you text us) may arrive at any time.
4. How to stop
You can revoke your consent at any time and in any reasonable way. Reply STOP, QUIT, END, CANCEL, UNSUBSCRIBE, OPT OUT or REVOKE to any message; click the unsubscribe link in a message; email privacy@araceagainstblindness.org; call 855-439-0122; or tell a member of our team. We honor requests within 10 business days and in practice immediately. After you opt out you will receive one final message confirming that you have been unsubscribed; it contains no marketing. A STOP request ends all RAB marketing texts, not just one campaign. If you ask us to stop texts, we will still reply to a message you send us asking for help.
5. Help
Reply HELP to any message, email privacy@araceagainstblindness.org, or visit araceagainstblindness.org/pages/help-center. Our HELP reply tells you the Program name and how to reach us.
6. Carriers and delivery
The Program is offered on major US and Canadian carriers. Carriers are not liable for delayed or undelivered messages. We are not responsible for messages that are delayed, undelivered or misdirected because of carrier issues, an incorrect number, or a number that has been reassigned. If you change your mobile number, your consent does not transfer; sign up again with the new number.
7. Privacy
Our Privacy Policy explains how we handle your mobile number, consent records (date, source, the disclosure you saw and, where captured, your IP address) and message history. We keep consent and opt-out records for as long as you are subscribed plus five years so we can prove consent and honor your request not to be contacted.
8. Canada
For Canadian numbers we rely on your express consent under Canada's Anti-Spam Legislation; we do not rely on any charity exemption. Every message identifies RAB, and you can unsubscribe by replying STOP or ARRET, by the link in the message, or by any method in Section 4; we honor requests within 10 business days. For Quebec residents we will provide these Terms and our help replies in French on request.
9. Changes and disputes
We may change the number we text from, the Program's content or these Terms; we will post the change here and, for material changes, tell you by text or email before it takes effect. If you continue in the Program after that notice, the new Terms apply. These Terms are part of our Terms of Use, including its dispute-resolution and governing-law sections.
